Work and Residence Permits
Here you find information regarding work and residence permits for employment and training purposes.
The following residence titles for specific purposes are known in the Austrian legal system:
Gainful employment
Settlement permit
- settlement permit for a key person (up to 18 months in case of granting first permit; includes access to labour market as a key person)
- unlimited settlement permit: includes full access to labour market
- limited settlement permit: e.g. in cases of family reunion; self-employed activity permitted, other employment permitted only with additional document issued by Public Employment Service Austria (AMS)
„Permanent Residence – EEC“
- after 5 years of uninterrupted residence
- includes full access to labour market
Residence permit
- Rotational worker (necessary document issued by AMS: confirmation of guaranteed work or employment permit as rotational worker)
- Persons dispatched by an enterprise (necessary document issued by AMS: confirmation of guaranteed work or employment permit as rotational worker; employment for more than 6 months)
- Self-employed persons (if foreigner is contractually committed to one particular activity and if such commitment will last for more than 6 months; AMS might be dealing with such)
- Artists (self-employed or employed; activity is predominantly determined by artistic activities and self-maintenance is covered by such; liability declaration not accepted; in case of employment one of the following documents issued by AMS is necessary: confirmation of guaranteed work or employment permit as artist)
- Special cases of employment activity (if activity is exempted by the law on employment of foreigners: proof of circumstances for exemption necessary)
- Researchers (against presentation of an admission agreement issued by a certified research institution)
Education and training
Employment activity permitted: self-employed or employed; latter allowed only, if a permit issued by the
Public Employment Service Austria (AMS)
exists. However, such employment activity must not detract from studies, which are the main goal.
Residence permit "student"
- for regular or extraordinary studies at an university, college or accredited private university
- for university courses, which do not serve exclusively for an acquisition of language capabilities
- liability declaration accepted
- in case of extension: proof of positive study results necessary
Residence permit "pupil"
- for regular pupils of a public school
- for regular pupils of a private school with public status
- for pupils of an educational institution certified by the Ministry of Interior
- for pupils of a statutory school with public status
- liability declaration accepted
- in case of extension: proof of positive study results necessary
Residence permit "social service worker"
- Maximum validity: 1 year (no extension permitted)
- if social service is not subject to the law on employment of foreigners and produced at a non-party, charity and non-profit-making institution
- if such a service does not pursue the goal of earning a living
- liability declaration issued by the carrier institution, at which the social worker performs his service, is obligatory
